General Terms and Conditions

 

Reservations All the reservations can be made thru our booking agents. Our booking agents can be reached over the email ( sales@via-croatia.com) , by filling the contact form on the web site, and/or by calling the official phone number stated on the website.

 

Deposits & Final payments First quote and offer is always FREE, for any additional changes you may be asked to pay the deposit. We keep the right to ask for $200 non-refundable deposit to make additional changes on the itinerary. Upon the confirmation, the deposit goes towards the final payment.

The final payment is due to 45 days prior to the departure. If we do not receive the final payment by the due date, we reserve the right to cancel the reservation and keep the deposit. In case of any billing errors we reserve the right to re-invoice with correct pricing. We also reserve the right to change the final price if the currency exchange rate changes drastically and more then 1.5% from the booking confirmation date. Since we are dealing mostly with Croatia and Europe we will look currency exchange rate for EUR (Euro) in comparison to USD (Dollar).

If the booking is confirmed 46 days or more before the departure Via Tours Croatia will ask for 20% down deposit to secure the services. Via Tours Croatia will ask remaining balance 45 days prior to the departure date when the balance will be adjusted if there is any currency fluctuation. 

 

Credit cards We accept major credit cards. Credit card charges require certain information and will be processed only upon submission of a completed form.

 

We use secure payment solutions  to either charge the card directly or to send electronic invoices for the client to pay the invoice on their own.

 

Via Tours Croatia does NOT charge extra fee for any credit card processing. The Final price that the client accepted is the amount Via Tours Croatia will charge the credit card for.

 

Returned checks A fee of $30 will be charged for any returned checks.

 

Revision fee Revision fee of $30 per transaction alterations or revisions. A change of tour date or tour itinerary within 45 days of departure will be treated as a cancellation and new booking; regular cancellation fees apply.

Cancellations and cancellation fees Cancellations must be advised to Via tours Croatia in writing. Per person cancellation fees apply as follows:

 

46+ days prior to commencement of service: 20% deposit to secure the booking – non-refundable

45-36 days prior: 35% of total price

35-26 days prior: 50% of total price

25-0 day(s) prior: 100% of total price

 

Optional tours cannot be refunded after purchase. Refunds will be refunded and processed within 30-45 days from the written notice has been received. 

Via Tours Croatia has special cancellation policy for FAM tours and other promotional tours where payments are fully non-refundable after the payments are received. 

Charters, all charters have special booking conditions and require 50% non-refundable down deposit and final payment, also non refundable, has to be made 60 days prior to the arrival date.

If Via tours, or booking partner, cancels a tour, we will re-book passengers on the same tour with a different departure date or a similar tour. All re-bookings are subject to availability. If that tour is unacceptable, Via tours will refund all funds paid to Via tours; there is no additional liability. Via tours cannot assume responsibility for any additional costs or fees relating to the issuance and/or cancellation of air tickets or other travel arrangements not made through Via tours.

 

Travel insuranceVia tours recommends the travel insurance. The insurance covers the cancellation charges, trip interruption, and/or baggage loss. Via tours has no responsibility for damaged or lost baggage and/or other personal belongings.

 

Refunds for unused servicesWith no exceptions, no refunds will be made for unused services once travel arrangements have commenced.

 

Service ComplaintsAll complaints must be received in written form directly to Via tours, either over the e-mail and/or mail. Complaints are accepted 30 days after the service was used. Please make sure to send the complaints in that time period as complaints received after 30 days will not be considered.

 

Passports & visasA valid passport is required of all tour participants. It must be valid six months after date of return. Your travel agent can help you obtain the necessary forms for passport application.

 

Non-US citizens must consult with the appropriate consulates to determine if any visas are needed. All passengers, regardless of the passport they hold, should check with the appropriate consulates to determine if any visas are needed. Securing any needed visas is the responsibility of the tour participant.

 

Health requirements Tour members should check with the consulates and/or the local health boards for the latest health requirements.

 

Travelers who need special assistance Any disability requiring special attention must be reported during the booking. Via tours will make all the efforts to accommodate any special needs passengers might have.

 

Young tour participants Tour participants under the age of 18 years must be accompanied by the adult. Depending on the age, discounts may apply.

 

Program Prices Program prices are per person, based on two persons sharing a room if otherwise not stated under tour description. Single room supplements are listed where applicable. All prices are based on rates (including foreign exchange rates) known at time of printing and expected to be in effect at departure. Prices, including taxes and fees, are subject to increase without notice if such rates change prior to departure.

 

Accommodations The hotels listed on an offer that is accepted will be used as confirmed. The categorization is always clearly stated, as well as the name of the hotel, during the booking process. Please note it is a standard policy that hotel rooms are available for check-in after 3 p.m. Early hotel check-ins/outs are possible depending on the occupancy at an extra charge. All the claims about the rooms must be made during check-in so Via tours can react immediately. Claims about the accommodation issues will not be considered after the service is over.

 

Air-conditioning Although available at most 3, 4 and 5 star hotels, conditions and use of air-conditioning abroad differs greatly from the United States. Many European hotels were built before central air-conditioning was introduced. Via tours will clearly state the working condition of air-condition in each hotel.

 

Included/Not included in program price Everything that is included in the program price you are not paying at the spot. However, all ‘’not included’’ items in a program are optional unless it is the obligatory extra charge such as tourist tax.

 

Safety Please be aware that during your participation in tours operated by Via tours, certain risks and dangers may arise beyond our control including, but not limited to, the hazards of traveling in undeveloped areas; travel by boat, train, automobile, aircraft or other means of transportation; the forces of nature, political unrest and accident or illness in remote regions without means of rapid evacuation or medical facilities. Via tours will not have liability regarding provision of medical care or the adequacy of any care that may be rendered. It is understood that Via tours will use its best efforts to ensure that adequate measures are taken.

 

Reservations and paymentsWe use Stripe Pay Way that applies the most modern standards in data protection - Secure Socket Layer (SSL) protocol with 128-bit encryption of data and MD5 algorithm. ISO 8583 protocol provides data exchange in a private network between T-com system and authorization centres of credit card companies. The private network is from unauthorized access protected with a double layer of the firewall.

TRAVEL AGENT FAM TRIPS TERMS AND CONDITIONS

Following terms and conditions are applicable to bookings for FAM trip. Any travel agent who books a service with Via Tours Croatia will be subject to the following terms and conditions:

Qualification : 
 
Travel agents must provide a current IATAN ID Card, or copy of IATAN List to be eligible for the FAM trip.  
 
All Land FAM Packages: Any Travel Credential will be accepted or a letter from the Travel Agency. Second traveler at companion rates regardless of professional or personal relationships. Companion might not be accepted to the FAM trip and acceptance is stricktly case of availability.
 
Travel Documents - Valid international passport with at least a 7-month validity beyond travel date is required for travel. Tour participants traveling on non US passport must advise  in advance, and verify entry eligibility. Via Tours Croatia  is not responsible for denied passage or entry for non US passport holders.
 
Transfers, Sightseeing,s, Tours: A complete program is offered throughout each tour packages as shown within the itineraries. Entrance fees to places of interest as well as lunches on full day outings where specified are included in the tour cost. Travel agent is responsible to participate in all scheduled tours, transfers, and activities and if one fails to participate Via Tours Croatia keeps the right to deny further participation and the agent will be responsible for his/her travel arrangements from that day of breach of the contract and Via Tours Croatia. Via Tours Croatia keeps the right to deny further attendence of an agent if the agent denies to follow the FAM program and does not participate in scheduled activities - all services will get canceled and the agent has obligation to cover his/her expenses from that day never the less the payment made for the FAM.
 
 
Domestic and International Air Agents are responsible for own flights to/from domestic US to connect with the int’l flights. No air deviations permitted. 
 
Non-Refundable: Payment is non-refundable once authorized.Payments are non-refundable. Unused tour features are neither refundable nor exchangeable once the tour is in progress. If the agent breaks the FAM rules, the agent will be dissmised from the FAM and the payment made will not get refunded.
 
Tour Performance Warranty: If for any reason within our control, Via Tours Croatia fails to provide any service, hotel, cruise, meal, or transportation as outlined in the final itinerary, an appropriate refund will be issued to the client upon presentation of a completed service adjustment coupon or written authorization from our overseas representatives. No claim can be considered if not made within 21 days from completion of tour. This does not apply to situations where the client/agent gets dismissed from the FAM by not following the FAM rules.
 
Responsibility and Liability: Via Tours Croatia, in operating these land arrangements is responsible to the tour participants for supplying the services and accommodations offered to the participants as stated in the final itinerary. Via Tours Croatia as tour operator, disclaims all liability for loss, damage or injury sustained in connection with services and accommodations provided by railroads, bus operators, local sight-seeing companies, tour operators, steamship companies, cruises, airlines, hotels and lodging facilities, all operating under the laws of the country in which these services are provided. The right to alter any land tour arrangement is reserved.  All rates are subject to change without prior notice.
 
FAM Trip Rules: Via Tours Croatia keeps the right to dismiss the agent from the FAM trip if any of the following rules are not followed: 
 
a) if the agent fails to follow the schedule as per detailed itinerary
b) if the agent makes any arrangement to meet with another tour company/hotel/supplier while on the FAM if not approvaed by Via Tours Croatia
c) if the agent disrespects any of the tour leaders, guides, and drivers while on the FAM
d) if the agent makes any attention during the FAM to negotiate with hotels, partners, and other suppliers to book directly and therefore tries to avoid booking with Via Tours Croatia in the future. This is valid until last FAM trip service has been provided. This includes asking for direct contacts of Via Tours Croatia partners during the FAM trip.

 
Breaking the rules of the FAM trip will result in immidiate FAM trip dissmissal and the agent will be keept liable to cover all his/hers further expenses from the time of dissmisal as Via Tours Croatia keeps the right to cancel all further services. Also, the agent will be kept liable to pay the difference in price from agent FAM trip rate and public rate for the given itinerary.
 
Indemnification, Waiver, and Release: By submitting the Reservation form and accepting and participating on this trip, the clients, personal representatives, successors, assigns, heirs, legal representatives, and next of kin agree to indemnify and hold Via Tours Croatia harmless and their respective officers, directors, employees, and agents  from and against any and all rights and/or claims that may have for any loss or damage arising out of or in any way related to, directly or indirectly, during the trip. Specifically, this Waiver and Release is intended to include, but not be limited to, any injuries, loss, or damage that may be caused by the negligence of Via Tours Croatia in sponsoring and/or organizing this trip.
